General Terms and Conditions of the SolarAkademie for seminars organised by the Deutsche Gesellschaft für Sonnenenergie Landesverband Berlin Brandenburg e.V.
1. general information
1.1 These General Terms and Conditions (GTC) apply to the seminars and in-house training courses organised by the Deutsche Gesellschaft für Sonnenenergie Landesverband Berlin Brandenburg e.V. (hereinafter referred to as DGS Berlin).
1.2 Supplementary terms and conditions or terms and conditions of business of contractual partners that contradict these GTC are excluded.
1.3 Amendments, supplements or ancillary agreements of any kind require the express written confirmation of DGS Berlin.
1.4 These GTC do not apply to other services provided by DGS Berlin, such as publications, expert opinions and consulting.
2. registrations
2.1 For didactic and spatial reasons, the number of participants in the seminars is limited.
2.2 Participants will be considered according to the order of registration.
2.3 Payment by instalments must be agreed in advance in writing with DGS Berlin and requires the approval of the management of DGS Berlin.
2.4 Registration for seminars is made in writing via our registration form on the Internet at www.dgs-berlin.de, by e-mail, fax or post. Receipt of the registration via our registration form on the Internet will be confirmed by e-mail. However, this confirmation of receipt does not yet lead to the conclusion of the contract and to a binding registration. Only when DGS Berlin has checked the registration and confirmed by e-mail that the participant's registration is binding does the contract between the participant and DGS Berlin come into effect.
2.5 By registering through one of the above options, the participant or the company recognises the General Terms and Conditions.
2.6 Upon confirmation by DGS Berlin, the registration becomes binding and a service contract is concluded.
2.7 The following applies to on-site training courses (hereinafter referred to as in-house training courses)

2.8 Participants' data will be stored electronically for internal purposes only.
3. requirements for participation
3.1 In principle, anyone who is at least 18 years of age can take part in DGS Berlin seminars.
3.2 The level of knowledge and learning objectives of the participants must be matched to the seminar content and requirements by the participants themselves. DGS Berlin is only available to provide advice to interested parties.
3.3 The seminar fee must be paid by the company/participant before the start of the seminar (for more details, see point 6 Payment conditions).
4. duties of the DGS Berlin
DGS Berlin is committed to ...
... to provide seminar documents for the participants. The content and scope shall be determined by DGS Berlin. The costs for this are included in the seminar fees, with the exception of the DGS guidelines accompanying the seminars for solar (specialist) consultants for photovoltaics or solar thermal energy and for the specialist courses for photovoltaics or solar thermal energy.
... to use only qualified speakers to conduct the seminars. These are recognised specialists in their respective fields. DGS Berlin reserves the right to change speakers. However, this does not entitle participants to cancel or reduce the fee.
... to provide a suitable training room and technology for the proper organisation of the seminars.
5 Obligations of the participants
Participants undertake to ...
... to provide complete and correct personal details. This includes the full name, valid billing address, telephone number or e-mail address. Should any details change before or during the seminar, DGS Berlin must be informed immediately.
… for participation in the seminar „Solar (specialist) consultant for photovoltaic or solar thermal systems“ or the specialist course „Photovoltaic or solar thermal systems“ before the start of the course for the purchase of a DGS guide "Photovoltaic systems" or "Solar thermal systems".
Derogation - A guide must:
- The participant does not need to purchase the latest version of the programme if he/she already has it.
- must be purchased at least once for every two participants in a company and no current version is yet available.
... to treat all materials, exhibits and vehicles provided by the DGS LV Berlin with care.
... to comply with the house rules applicable at the training centre.
... in the case of in-house training, to provide a suitable training room and technology for the proper organisation of the training free of charge.
6 Course fees and terms of payment
6.1 The prices listed at the time of registration shall be decisive for invoicing.
6.2 The invoice will be sent by DGS Berlin to all participants or the company by post or electronically two to four weeks before the start of the course and must be credited to the DGS Berlin account no later than three working days before the start of the course. If the participation fee has not been received by DGS Berlin by the start of the event, DGS Berlin has the right to deny the participant participation in the event.
6.3 Participation in a seminar for only part of the time does not entitle the participant to a reduction in the course fee.
6.4 If the payment deadline is exceeded, DGS Berlin is entitled to charge interest on arrears in accordance with the statutory regulations without further reminder.
6.5 In the case of in-house training courses, the seminar fees and ancillary costs confirmed in writing between the contracting parties shall apply.
6.6 Any incidental costs incurred for money transfers (e.g. for transfers from abroad) shall be borne by the client.
6.7 State subsidies or grants for the seminar fees can be claimed after prior consultation.
7. further costs and discounts
7.1 Participants are responsible for their own accommodation, travel and catering costs.
7.2 In the case of in-house training courses, the contractual partner shall also bear the above-mentioned costs for the lecturers if these are not included or shown in the offer.
7.3 DGS members receive a discount of 10% on the course fee and the guide. No discount is granted on examination fees.
7.4 If there are several participants from one company, every second participant receives a discount of 30% on the course fee.
8. realisation
8.1 Irrespective of the type and content of the training, DGS Berlin is entitled to use the assistance of third parties to fulfil its contractual obligations.
8.2 DGS Berlin reserves the right to change lecturers and instructors.

8.3 Seminars and training courses will only be held if the minimum number of participants is reached. There is no entitlement to compensation for cancelled seminars. In this case, seminar fees already paid will be refunded in full. The reimbursement of further costs (e.g. travel expenses, accommodation, etc.) is expressly excluded.
9. examination and certificates
9.1 Participants will receive a certificate of attendance after the seminar. This entitles the participant to take the examination and obtain a certificate. The participant must be present for at least 90 % of the seminar time.
9.2 The examination and certification are based on the guidelines of the seminars and their annexes. These can be requested.
10. cancellation deadlines, exclusion and withdrawal
10.1 Registration is binding. If the participant is unable to attend, he/she may cancel up to twelve working days before the start of the course for a processing fee of € 50.
10.2 In the event of cancellation after this deadline, the following conditions apply:
- Cancellation after the deadline but before the start of the course - 50 % of the course fee
- Absence from the course - 100 % of the course fee
10.3 Cancellations must be made in writing and receipt must be confirmed by DGS Berlin. Absence from seminars does not constitute cancellation.
10.4 DGS Berlin reserves the right to cancel for organisational and technical reasons (such as force majeure, failure to reach the minimum number of participants or short-term absence of speakers due to illness).
10.5 In the event of cancellation by DGS Berlin, a rebooking to another date and/or venue will be made in consultation with the participants. If this is not possible, participants will be refunded the fees they have paid. Any further claims, in particular compensation for travel and accommodation costs and loss of working hours, are excluded.
10.6 All participants of a company are considered to be individually registered participants and will be charged fees for violations.
10.7 DGS Berlin reserves the right to exclude participants who significantly disrupt the event through their behaviour from further participation after prior warning. In this case, the seminar fees will not be refunded.
11. liability
11.1 DGS Berlin is liable for accidents within the scope of the statutory provisions. DGS Berlin is not liable for the loss or theft of items or vehicles brought onto the premises.
11.2 DGS Berlin is liable for damages caused by it or its employees intentionally or through gross negligence.
11.3 All recommendations and forecasts within the framework of the seminar are made to the best of our knowledge and belief in accordance with the current state of knowledge. DGS Berlin accepts no liability for the content of such recommendations and forecasts.
11.4 Warranty claims or claims for damages against DGS Berlin, regardless of the legal grounds, expire after six months. In case of doubt, the period begins with the end of the seminar. In the event of damage caused by participants, the registering company/participant is liable in accordance with BGB §823 and is obliged to compensate for the damage. 1)
12. copyrights and copyright
12.1 In addition to conducting the training, the service includes the provision of the associated training documents for the participants to keep.
12.2 DGS Berlin grants the non-exclusive right to use these documents exclusively for its own and internal purposes.
12.3 DGS Berlin reserves all further rights, including those of translation, reprinting and reproduction of the training documents or parts thereof.
12.4 No part of the training documents may be reproduced in any form - including extracts - without written authorisation, including for the purposes of teaching, and in particular may not be processed, duplicated, distributed or used for public reproduction using electronic systems.
12.5 The recording of the course with electronic systems (audio, video) is not permitted without the consent of DGS Berlin.
13. data protection
13.1 The data of participants and companies will be recorded electronically and stored by DGS Berlin for internal purposes only. The company/participant has the right to object to the storage and use of his/her personal data at any time.
14. other
14.1 The contractual relationship and its implementation shall be governed exclusively by German law.
14.2 Should one or more provisions of these General Terms and Conditions be or become invalid or should this contractual text contain a loophole, the contracting parties shall replace or supplement the invalid or incomplete provision with appropriate provisions that correspond as far as possible to the economic purpose of the intended provision. The validity of the remaining provisions shall remain unaffected.
14.3 DGS Berlin reserves the right to amend the General Terms and Conditions at any time. These can be requested at any time or viewed on the DGS Berlin website. www.dgs-berlin.de can be viewed here.
14.4 The provisions applicable at the time of conclusion of the contract shall apply.

Anyone who unlawfully injures the life, body, health, freedom, property or any other right of another person, whether intentionally or negligently, is obliged to compensate the other person for the resulting damage.
