General Terms and Conditions of DGS
German Society for Solar Energy Berlin Brandenburg Regional Association

1. general information

1.1 These General Terms and Conditions (GTC) apply to the
Landesverband Berlin Brandenburg e.V. (hereinafter referred to as DGS Berlin) of the
German Society for Solar Energy e.V.

1.2 Supplementary terms and conditions or terms and conditions of business of contractual partners that contradict these GTC are excluded.

1.3 Amendments, supplements or collateral agreements of any kind
require the express written confirmation of the DGS

1.4 The General Terms and Conditions for DGS Seminars of the SolarAkademie of the Berlin Brandenburg State Association apply to the services provided as part of the DGS SolarAkademie of the DGS Berlin. AGB SolarAkademie

2. general terms of payment and other costs

2.1 Invoicing shall be based on the prices applicable at the time of invoicing.

2.2 The invoice will be sent by post by DGS Berlin and must be credited to the DGS Berlin account no later than 10 working days after receipt.

2.3 Payment by instalments must be agreed in advance in writing with DGS Berlin and requires the approval of the management of DGS Berlin.

2.4 If the payment deadline is exceeded, DGS Berlin is entitled to charge interest on arrears in accordance with the statutory regulations without further reminder.

2.5 Any incidental costs incurred for money transfers (e.g. for transfers from abroad) shall be borne by the client.

2.6 Shipping costs are to be paid by the client.

2.7 Any travelling expenses incurred will be invoiced separately.

3. framework conditions for engineering services

3.1 The reports, studies and expert opinions of the DGS Berlin are published according to
to the best of our knowledge and belief and correspond to the state of the
Science and technology.

3.2 DGS Berlin is not liable for incorrect results caused by incomplete or incorrect information provided by the client.

3.3 All contractually relevant framework conditions, over and above the legal bases of the German Civil Code (BGB), shall be set out in writing in individual contracts with the clients prior to the provision of services.

3.4 Further claims for damages are excluded, except in cases of gross negligence or intent. 1)

4. framework conditions in the projects area

4.1 In the case of co-operation with one or more project partners, the regulations and guidelines provided by the funding body shall apply.

4.2 Individual agreements over and above this must be recorded in writing between DGS Berlin and the project partner. These must be compatible with the General Terms and Conditions of DGS Berlin.

5. framework conditions in the Publications division

5.1 Dispatch and shipping costs
5.1.1 For deliveries of goods abroad with an order value of over EUR 50.00, payment shall be made in advance. For all deliveries of goods abroad below EUR 50.00 and within Germany by invoice.

5.1.2 DGS Berlin ships worldwide, provided delivery can be realised.

5.1.3 The shipping costs shall be allocated to the invoice amount and shall be charged as agreed.

5.2 Transport damage
5.2.1 The ordered goods will be dispatched in perfect condition.

5.2.2 The customer undertakes to report any defects that occur without delay.

5.2.3 In the event of proof of a faulty delivery, a fault-free replacement shall be provided. If a faultless replacement is not possible or has not been made within six weeks, the contract may be cancelled.

5.2.4 A reasonable flat-rate inspection fee will be charged for goods that are the subject of a complaint and do not show any defects despite thorough inspection. If the return is justified, DGS Berlin will bear all costs incurred for normal shipping.

5.2.5 Further claims for damages are excluded, except in cases of gross negligence or intent. 1)

5.3 Delivery times
5.3.1 The goods will be dispatched nationwide by DHL within 5 working days of receipt of the order at the latest. The prerequisite for this is that all invoice and delivery data are available and the goods are available. Shipments abroad may vary in time. Please refer to the DHL delivery information for exact delivery times.

5.4 Right of cancellation and returns
5.4.2 Returns must always be sent prepaid. Unpaid shipments will not be accepted. Returns must be accompanied by a copy of the invoice and, if necessary and possible, a description of the fault.

5.5 Retention of title
5.5.1 The goods remain the property of DGS Berlin until full payment has been received.

6. copyrights and copyright

6.1 The service includes all documents, Internet content and publications written by DGS Berlin employees.

6.2 DGS Berlin grants the non-exclusive right to use these documents exclusively for its own and internal purposes.

6.3 DGS Berlin reserves all further rights, including those of translation, reprinting and reproduction of the documents or parts thereof.

6.4 No part of the documents may be reproduced in any form, including extracts, without the written permission of DGS Berlin, in particular processed, copied, distributed or used for public reproduction using electronic systems.

7.1 The data of clients and the companies will be

8. other

8.1 The contractual relationship and its implementation shall be governed exclusively by German law.

8.2 Should one or more provisions of these General Terms and Conditions be or become invalid or should this contractual text contain a loophole, the contracting parties shall replace or supplement the invalid or incomplete provision with appropriate provisions that correspond as far as possible to the economic purpose of the intended provision. The validity of the remaining provisions shall remain unaffected.

8.3 DGS Berlin reserves the right to change the general
Terms and Conditions at any time. These can be changed at any time
or on the DGS website www.dgs-berlin.de can be viewed here.

8.4 The provisions applicable at the time the contract is concluded shall apply.
